Notice of Rulemaking Hearing for the Tennessee Board for Licensing Contractors

Pursuant to Tenn. Code Ann. § 4-3-1306(d), you are receiving this notice because you have elected to receive notification by e-mail of certain changes or potential changes to the law applicable to your profession.

The Tennessee Board for Licensing Contractors held a rulemaking hearing on March 28, 2017, in Conference Room 1A of the Davy Crockett, 500 James Robertson Pkwy, Nashville, TN 37243 concerning the rules linked below. These rules will go into effect September 6, 2017.

A summary of the rule changes are as follows:

  • Amendment to 0680-01-.02 clarifies who may be designated as a qualifying agent for different types of entities and creates a deadline regarding how long a contractor has to replace a qualifying agent before the license becomes invalid. The rule also mandates that the license of an individual or sole proprietorship shall automatically become inactive three (3) months after death of the individual or individual owner of the sole proprietorship unless another person or entity has applied to transfer the license.
  • Amendment to 0680-01-.13 clarifies rules regarding personal guaranties used by licensees to supplement their financial statement in order to increase their license monetary limitation.
  • Amendment to 0680-01-.16 adds details to existing license classifications and renames current classifications to clarify what work is covered by that classification.
  • Amendment to 0680-01-.24 requires roofing subcontractors to report their license information accurately to general contractors when the roofing project is twenty-five thousand dollars ($25,000.00) or more.
  • Amendment to 0680-01-.28 renames current rule "Emergency Actions" as "Temporary Licensing" and adds details on the expedited licensed procedure for military personnel and spouses as required by T.C.A. § 4-3-1304. All other aspects of the rule remain the same.
  • Amendment to 0680-07-.08 amends the current rule pertaining to temporary licenses for home improvement applicants and adds details on the expedited licensed procedure for military personnel and spouses as required by T.C.A. § 4-3-1304.
  • New rule 0680-07-.15 details the grounds for disciplinary action by the Board against home improvement licensees and corresponding penalty amounts.
  • New rule 0680-07-.16 Contracting in Correct Name; Change of Name clarifies that home improvement licensees have a responsibility to enter into contracts and operate related contracting business under the name in which they are licensed in order to notify and prevent confusion on the part of the public at large regarding an entity's licensure status.
  • New rule 0680-07-.17 lists grounds for disciplinary actions against home improvement licensees.
