New/Amended Rules for the

Tennessee Debt-Management Services Registration Program

Pursuant to Tenn. Code Ann. § 4-3-1306(d), you are receiving this notice because you have elected to receive notification by e-mail of certain changes or potential changes to the law applicable to your profession.

New rules were filed with the Secretary of State on October 28, 2016 regarding the Tennessee Debt-Management Services Registration Program. These rules have been filed as Proposed Rules and will be promulgated without a hearing ninety (90) days from the filing date unless a petition is received by at least ten (10) persons who will be affected by the amendments, or submitted by a municipality which will be affected by the amendments, or an association of ten (10) or more members, or any standing committee of the General Assembly.

These proposed rules are additions, amendments, and deletions as described below:

- Rules 0780-08-01-.01 through 0780-08-01-.13 are deleted in their entirety and renumbered 0780-05-18-.01 through 0780-05-18-.12 and 0780-05-18-.17 to move them under the Chapter regarding the rules of the Division of Regulatory Boards.

- New Rule 0780-05-18-.13 provides for a process to submit electronically scanned fingerprints for registration as a debt-management service business.

- New Rule 0780-05-18-.14 provides the calculation for an increase to the registration fee in accordance with inflationary adjustment based off of the consumer price index.

- New Rule 0780-05-18-.15 establishes what and how entities may be considered to be accredited as required by statute for the purposes of registration of a debt-management service business.

- New Rule 0780-05-18-.16 establishes what and how employees of a debt-management service business may be certified as required by statute for the purposes of registration of a debt-management service business.
