Notice of Effective Date for New Rules for

Tennessee Motor Vehicle Commission

Pursuant to Tenn. Code Ann. § 4-3-1306(d), you are receiving this notice because you have elected to receive notification by e-mail of certain changes or potential changes to the law applicable to your profession.

On October 6, 2015, the Tennessee Motor Vehicle Commission approved a rule affecting the sale of salvage, rebuilt, or salvage history motor vehicles. This rule became effective on October 5, 2016. This new rule created Tenn. Comp. R. & Regs. § 0960-01-.29 establishing written disclosure requirements on all motor vehicle dealers or salespersons who knowingly sell any motor vehicle with a salvage title, a rebuilt title or has any history of being a salvage vehicle. The disclosure must be on the form provided in the rule.

On January 11, 2016, the Tennessee Motor Vehicle Commission approved a rule affecting the termination of motor vehicle dealer franchise agreements. This change became effective October 5, 2016 and amends Tenn. Comp. R. & Regs. § 0960-01-.06. The rule provides that when a manufacturer or distributor provides notice to terminate a motor vehicle dealer franchise agreement the motor vehicle dealer may petition the Tennessee Motor Vehicle Commission for a declaratory order determining whether the termination would be unfair, without due regard to the equities, or without just provocation. The rule requires the manufacturer or distributor be served with the petition for declaratory order and be a party to the hearing.

On April 25, 2016, the Tennessee Motor Vehicle Commission approved a rule affecting motor vehicle dealer surety bonds. This change amends Tenn. Comp. R. & Regs. § 0960-01-.22 so that the surety bond no longer needs to explicitly name the Tennessee Motor Vehicle Commission as the beneficiary to the surety bond. This rule became effective on October 20, 2016.
