Notice of Effective Date for New Rules of the
Tennessee Board of Funeral Directors and Embalmers
Pursuant to Tenn. Code Ann. § 4-3-1306(d), you are receiving this notice because you have elected to receive notification by e-mail of certain changes or potential changes to the law applicable to your profession.
The Tennessee Board of Funeral Directors and Embalmers (“Board”) approved the proposed rules at the rulemaking hearing conducted on May 10, 2022. The rules were filed with the Secretary of State on November 4, 2022 and will become effective February 2, 2023. The rules have been filed as Rulemaking Hearing Rules and will be promulgated ninety (90) days from the filing date.
The proposed rules amend the requirements for apprentice funeral directors. Presently, apprentice funeral directs are required to work forty (40) hours per week in the presence of and under the direction or supervision of a licensed funeral director. The proposed rules amend this requirement to thirty-two (32) hours pursuant to 2021 Public Chapter 549, Section 14. Further, the standards of professional conduct are amended to prohibit unreasonable conduct towards the public and specifically identifies the prohibited conduct. Additionally, the proposed rules require a funeral establishment to release the human remains to a second funeral establishment when requested by the family (person with the right of disposition). Lastly, the rules require that interaction with the public must be in regard to the sensibilities of the public.
